(PN 20) The College and University Criminal History Background Investigation Act states that an institution of higher education may conduct a criminal history background investigation prior to hiring an individual for a full-time faculty or staff position. The bill also states that when an administrator of an institution of higher education is in receipt of information which is part of a final candidate's criminal history record information file, the administrator may use that information for the purpose of deciding whether to hire the candidate. Lastly, an institution of higher education may require an individual offered employment as a full-time faculty member or staff member to self-disclose certain criminal history information on a self-disclosure form.

The bill outlines how a municipality may create a culture development district and states that at least one public hearing must be held on the issue. Within three weeks of the hearing, the municipality shall adopt and ordinance or resolution if it wishes to apply for the district and then the Department of Community and Economic Development shall review the application and determine its acceptability by looking at several factors enumerated in the legislation. If a district is created, businesses shall benefit from the program as soon as they move into the district. However, no business may transfer benefits by moving from one district to another. Districts are to terminate five years after creation and pertinent tax credits are to be phased out.

(PN 9) The Child Welfare Workers Loan Forgiveness Act establishes the Child Welfare Workers Loan Forgiveness Program, which gives PHEAA the authority to forgive a proportional part of student loans of commonwealth residents who graduate from institutions of higher education and who apply their degrees to careers in child welfare work so that the loan may be partially or entirely forgiven for each year that the qualified applicant is employed by a certified child welfare employer. The bill provides for applicant and employer eligibility, and stipulates limitations. The bill also outlines funding procedures. Loan forgiveness awards may be made to the extent that funds are appropriated by the General Assembly or available from other sources and are sufficient to cover the administration of the program. If funding is insufficient to fully fund the administration and all eligible applicants, priority shall be given to renewal applicants, after which point, a random lottery system is prescribed for determining which applicants receive loan forgiveness awards. The bill outlines the responsibilities of PHEAA and provides for an annual report to be submitted to the General Assembly.

(PN 18) The Volunteer Emergency Service Tuition Credit Program Act authorizes a person who is an active member of a volunteer fire company, volunteer ambulance service, or volunteer rescue squad in good standing and the dependent children and spouse of such volunteer to enroll in postsecondary courses on a tuition-credit basis in a community college. A volunteer and the volunteer's dependent children and spouse would be eligible to receive tuition credit in the aggregate amount of $600 per year, not to exceed an aggregate maximum of $2,400 over a four-year service period. In order to receive a tuition credit, the volunteer would agree to serve as a member of a volunteer fire company, volunteer ambulance service, or volunteer rescue squad for a minimum of four years and sign an agreement with the volunteer organization pledging four years of service in exchange for the tuition credit.

(PN 19) The Volunteer Emergency Service Personnel Educational Assistance and Loan Forgiveness Act creates the Educational Assistance and Loan Forgiveness Program to provide grants to receive payments by PHEAA for debt incurred as a result of student loans entered into for the purpose of pursuing programs of education. To be eligible for the program, an applicant must be: (1) a qualified resident of Pennsylvania; (2) an active member of a volunteer fire company, emergency service team or rescue team for a period of at least one year in Pennsylvania; (3) enrolled as a student in an approved program of education at an approved institution of higher learning; and (4) provide the approved institution of higher learning with a sworn or official statement of fact by the state fire commissioner, or president or commissioner of a volunteer fire department of which the applicant is a volunteer, attesting that the applicant is a member in good standing of the volunteer fire company, emergency service team or rescue team. Grants for part-time students would not exceed one-half the tuition of the part-time course of study in which the part-time student applicant is enrolled and grants for full-time students would not exceed $3,700 per academic year or the actual amount of the applicant's tuition for the academic year. Additionally, for each year that an applicant is a member of a volunteer fire company, emergency service team or rescue team, PHEAA may forgive a proportional part of the applicant's loan so that the loan may be entirely forgiven over a maximum period of five years in which the applicant is attending an approved institution of higher learning. No more than $2,000 would be forgiven in any year.

A neighborhood electric vehicle operated upon any highway or roadway is required to be maintained in proper condition and comply with the equipment requirements and standards as set forth in 49 CFR 571.500 (relating to Standard No. 500; Low-speed vehicles). A neighborhood electric vehicle shall be properly titled and registered with the Department of Transportation. Local authorities may permit the use of a neighborhood electric vehicle where the posted speed limit is greater than 25 miles per hour but not greater than 35 miles per hour. "Neighborhood electric vehicle" is defined as a four-wheeled electric vehicle that has a maximum design speed of not less than 20 miles per hour and of not more than 25 miles per hour and that is certified by the manufacturer to comply with the federal motor vehicle safety standards.

Schools of Excellence may be sponsored by and located at Pennsylvania institutions of higher education that previously sponsored Governor's Schools. Schools of Excellence shall be held, to the extent possible, during the summer months. Students attending a School of Excellence shall not be required to pay any tuition or fees to attend and participate in a School of Excellence. The department shall report annually on the program and provide funding for the Schools of Excellence out of its general appropriation.

The bill gives the Secretary of Education certain powers with regard to post baccalaureate training, including reviewing approving programs and issuing certificates. Requirements are given for when the secretary may grant a one-time residency certificate for areas with teacher shortages and grants the secretary powers and duties over residency certificates. The secretary is also given the power to issue a one-time instructional intern certificate, which shall be valid for three years. A life sciences entity shall receive a tax credit equal to 50 percent of the funds contributed by a life sciences entity to a public institution of higher education, independent institution of higher education or State-related institution for the specific purpose of funding salaries of life sciences students employed at the institution in a life sciences internship. A life sciences entity shall not qualify for employment of a life sciences student in a life sciences internship for a period in excess of nine months for all tax years. A life sciences entity shall not qualify unless the life sciences internship in which the student is employed is a requirement the student has not yet completed and must satisfy in order to complete his course of study. Any credit granted under this article may not exceed 25 percent of the tax liability of the life sciences entity. The total aggregate amount of all tax credits shall not exceed $5,000,000 in a fiscal year. The Department of Community and Economic Development, in consultation with the Department of Education, shall develop guidelines for the approval of applications.

A volunteer and the volunteer's dependent children and spouse would be eligible to receive tuition credit in the aggregate amount of $600 per year, not to exceed an aggregate maximum of $2,400 over a four-year service period. In order to receive a tuition credit, the volunteer would agree to serve as a member of a volunteer fire company, volunteer ambulance service, or volunteer rescue squad for a minimum of four years and sign an agreement with the volunteer organization pledging four years of service in exchange for the tuition credit.

To be eligible for the program, an applicant must be: (1) a qualified resident of Pennsylvania; (2) an active member of a volunteer fire company, emergency service team or rescue team for a period of at least one year in Pennsylvania; (3) enrolled as a student in an approved program of education at an approved institution of higher learning; and (4) provide the approved institution of higher learning with a sworn or official statement of fact by the state fire commissioner, or president or commissioner of a volunteer fire department of which the applicant is a volunteer, attesting that the applicant is a member in good standing of the volunteer fire company, emergency service team or rescue team. Grants for part-time students would not exceed one-half the tuition of the part-time course of study in which the part-time student applicant is enrolled and grants for full-time students would not exceed $3,700 per academic year or the actual amount of the applicant's tuition for the academic year. Additionally, for each year that an applicant is a member of a volunteer fire company, emergency service team or rescue team, PHEAA may forgive a proportional part of the applicant's loan so that the loan may be entirely forgiven over a maximum period of five years in which the applicant is attending an approved institution of higher learning. No more than $2,000 would be forgiven in any year.

A neighborhood electric vehicle shall be properly titled and registered with the Department of Transportation. Local authorities may permit the use of a neighborhood electric vehicle where the posted speed limit is greater than 25 miles per hour but not greater than 35 miles per hour. "Neighborhood electric vehicle" is defined as a four-wheeled electric vehicle that has a maximum design speed of not less than 20 miles per hour and of not more than 25 miles per hour and that is certified by the manufacturer to comply with the federal motor vehicle safety standards.

Public institutions of higher education must submit reports to the Department of Education detailing compliance with this requirement. Additional powers and duties are placed upon the Transfer and Articulation Oversight Committee. State related institutions must list at least 30 credit hours of courses they will accept in furtherance of this requirement upon transfer from another institution of higher education and the course shall count as it would if the course were originally taken at the state-related institution.

The selection of candidates to the program would be based on demonstrated need, willingness to continue practicing as a physician in Pennsylvania after completing the program, and eligibility. The bill provides for the amount of loan forgiveness. A physician accepted into the program practicing full time may be reimbursed an amount up to 100% of the total loan for physician training, up to $75,000, based upon a repayment assistance schedule. The bill states that physicians receiving loan forgiveness must enter into a contract with the agency. The bill outlines the terms and conditions of the contract. The bill would appropriate $10,000,000 annually to carry out the purposes of the act.

(PN 326) Amends the Tax Reform Code establishing a life sciences education tax credit to encourage the creation of internships and fellowships by life sciences entities for life sciences students. A life sciences entity shall receive a tax credit equal to 50 percent of the funds contributed by a life sciences entity to a public institution of higher education, independent institution of higher education or State-related institution for the specific purpose of funding salaries of life sciences students employed at the institution in a life sciences internship. A life sciences entity shall not qualify for employment of a life sciences student in a life sciences internship for a period in excess of nine months for all tax years. A life sciences entity shall not qualify unless the life sciences internship in which the student is employed is a requirement the student has not yet completed and must satisfy in order to complete his course of study. Any credit granted under this article may not exceed 25 percent of the tax liability of the life sciences entity. The total aggregate amount of all tax credits shall not exceed $5,000,000 in a fiscal year. The Department of Community and Economic Development, in consultation with the Department of Education, shall develop guidelines for the approval of applications.

The institution of higher education may provide the department with identifying information for only those students who have not opted out of the department's collection of identifying information. The Secretary of Education shall establish an advisory committee to offer recommendations to the department concerning the collection of identifying information and other data from institutions of higher education.

A governing authority, as defined in the bill, shall establish and administer a course of study and training for judges in domestic violence, to be at least 20 hours in length; establish the minimum qualifications for instructors; and consult, cooperate and contract with universities, colleges, law schools and mental health and health care professionals regarding the development of education courses in the program and the teaching of those courses.
